A federal trade commission investigation into alleged patent infringement by Nortel has been “terminated”, the networking company said Thursday.

The investigation by the US International Trade Commission had been triggered by Ciena Corporation against Nortel and Flextronics International.

“This follows a preliminary injunction, recently issued by the U.S. District Court in Marshall, Texas, barring Ciena from participating in or pursuing the ITC action, and requiring Ciena to seek termination of the investigation by the ITC,” Nortel said.

Nortel had denied the allegations and in turn filed counterclaims saying Ciena had infringed on 13 Nortel patents. A trial is set for June of next year, according to Nortel.
